D161,025 Nov. 28, 1950 Combined electrical Jig saw and sander Allen L. Atkins Chicago, IL National Scientific Products Co. contracted with Allen Atkins to develop this combined scrollsaw and sander. Atkins paid the development costs and owned the patents. National manufactured the product and paid Atkins a royalty. Co-inventor Elmer Hoffman was an employee of National. About 30,000 of these saws were sold in 1949, including about 10,000 sold through Burgess Vibrocrafters, Inc. National decided to discontinue manufacture of this saw, and solicited offers for the tools, dies and inventories from both Burgess and Atkins. Atkins' offer was accepted. Burgess hired Raymond and Hilmar Andresen to design a new saw (see patent 162,279) and began manufacture of that design in competition with Atkins. After Hoffman and Atkin's patent was issued in November 1950, Atkins threatened Burgess's customers and distributors with infringement lawsuits. Burgess responded by filing for declaratory judgement. Once the dust had settled, Hoffman and Atkin's patent was declared invalid because it "does not exhibit that creative artistry requisite to the monopoly protection which the statute accords."
An example of this saw has its original cardboard box, which reads, "ONE 3 in 1 JIG SAW. Another Clinton Specialty Works Product. Clinton Specialty Works 2645 N. Paulina St. Chicago 14, Illinois". The saw and associated paperwork indicate the saw was made by "Atkins Industries, Inc., 1751 W. Devon Ave., Chicago 26, IL. The paperwork is dated 1950.
